Planning commission approves 18‑month time extension for conditional use permit at 5835 All Red Road

The Mariposa County Planning Commission on May 8 voted unanimously to adopt staff findings and approve an 18‑month time extension for a conditional use permit for Martin Bestetter (Plan DIS2025‑00062), moving the approval expiration to Feb. 5, 2027.

County staff (Elijah) described the request as "an 18 month, time extension request" for the existing conditional use permit. He said the property is located at 5835 All Red Road (APN 014‑070‑007), is about 26.5 acres and zoned Agricultural Exclusive. The original conditional use permit (application 2022‑067) was approved by the commission on Aug. 5, 2022 via resolution 2022‑008.

Staff told commissioners that the applicant did not propose any changes to the approved project and that a building permit (BLDR2025‑00431) was submitted May 5, 2025 — before the prior approval expired — which supports the requested extension. Staff also said no comments were received from inter‑county agencies or the public during circulation.

On environmental review, staff recommended the extension without further CEQA review under the "common‑sense exemption" and cited the county’s applicability of CEQA Guidelines section 15061(b)(3), which states that where it can be seen with certainty there is no possibility a project will have a significant effect on the environment, no further review is required.

A commissioner moved to adopt the staff recommendation and the resolution approving the time extension; another commissioner seconded and the motion carried unanimously.

Next steps: If the conditions of approval are not completed and the project is not fully implemented by Feb. 5, 2027, staff said a new conditional use permit application will be required for any previously approved conditions not completed during that extension period.
