City engineering staff told the board on June 15 that the Greenwood Village South expansion along U.S. 31 requires a pathway along the front edge of the highway. Most of the pathway will sit within a recorded trail easement outside INDOT right of way, but a roughly 30‑foot stretch at the south end would fall inside INDOT's right of way.
Staff said INDOT has agreed to allow the pathway within its right of way provided a joint‑use and maintenance agreement is executed. Under the agreement, the city will inspect and accept the installed pathway; once accepted the city will assume maintenance responsibilities.
The board moved, seconded and approved execution of the joint‑use/maintenance agreement by voice vote.
What happens next: staff will finalize the legal agreement with INDOT and proceed with construction and inspection as the Greenwood Village South project advances.
