Homeowner Janiro Kosolino received approval from the Town of Babylon Zoning Board of Appeals to expand his Deer Park residence, the board announced after a motion and voice vote at the meeting.
Kosolino told the board he seeks to construct an eight-by-fifteen-foot two-story side addition to expand existing first- and second-floor bedrooms so his mother, who now uses a walker and may eventually require a wheelchair, can live on the ground floor. "We're requesting relief from the board to construct a new 8-by-15 two-story side addition," Kosolino said during his presentation.
The application requested three variances: an increase in building area to about 31.34% of the lot where 20% is permitted (a difference of roughly 11.34 percentage points, approximately 1,076 square feet); a front-yard setback modification affecting an existing portico; and a rear-yard setback reduction to 28.74 feet where 40 feet is the standard. Kosolino told the board the proposed front and rear additions will be built over the existing footprint and will not extend further into setbacks.
Board members questioned occupancy and utilities; Kosolino said the household currently includes him, his fianc e9 and his mother, and that the house will have two kitchens because he is applying for an accessory apartment permit. The board imposed conditions that the accessory unit retain internal access to the rest of the dwelling and that the front porch and portico not be enclosed. Kosolino agreed to those conditions.
A board member moved to approve application 2669 "with the full conditions that we just read," and another board member seconded the motion. The chair called for a voice vote and the motion carried. The board indicated a decision letter will be mailed to the applicant with the written conditions and details.
The approval does not replace required building permits. The board reminded the applicant that construction may not begin until all necessary building-department permits are obtained.
The board moved next to other calendar items; the Kosolino approval was the only final action taken at the meeting.
