At a continuation of a public hearing on June 8, Wareham planning staff told the board that an August 2019 subdivision approval had been recorded without the expected covenant and that subsequent lot conveyances meant the subdivision is active despite prior assumptions of expiration.
Staff advised the board and the applicant that any construction or building permit for work tied to the subdivision is subject to the 2019 plan set and to the town's subdivision rules and regulations, including required staged inspections and a Form N for release/closeout. Phil (town consultant) and staff said the road shown on the plan requires inspection signoffs and that utilities and any conditions tied to the approval must be satisfied before final acceptance or permits progress.
Citizens raised conservation concerns (vernal pool, pedestrian easement) and asked for notice to nearby landowners; the board acknowledged gaps in prior recordkeeping and directed staff to enforce the existing plan set requirements and inspections.
The board closed the public hearing on that matter, concluding staff will require the applicant to file the necessary forms, provide inspection access and address HOA requirements as part of any release.
