The Yarmouth Zoning Board of Appeals on June 11 approved a special permit allowing SRS Building Products to store hazardous materials at 60 Anzel Hallet Road, the former FedEx property, subject to conditions recommended by the Town’s Board of Health.
Attorney Eliza Cox, representing property owner Ansel and Gretle LLC, said SRS will be a wholesale distributor of roofing and exterior building products. Cox described expected inventory in original manufacturer packaging: about 266 gallons of wholesale hazardous materials plus roughly 64 gallons of company-use materials, for an on-site total estimated at about 330 gallons; the applicant requested authorization to store up to 400 gallons to allow for inventory turnover.
Cox told the board that all hazardous products will be stored indoors on spill-control pallets exceeding the Board of Health’s required 150% secondary containment and that no on-site vehicle washing or truck refueling will occur. "We think this is a much more protective use of the APD than the prior use of the site," Cox said, referencing the prior FedEx maintenance activities.
The Board of Health, represented in a May 22 memorandum from hazardous materials inspector Carl E. Lawson Jr., recommended approval with three specific conditions: limit maximum on-site storage of toxic or hazardous materials to 400 gallons total; conspicuously post a detailed material spill‑containment plan and ensure employees are familiar with it; and prohibit vehicle washing on site. The ZBA agreed to incorporate the board of health memorandum and its requirements into the zoning decision.
SRS regional manager John Marone told the board the company trains employees annually on hazardous materials handling and reported he had no prior spills in 14 years of operations. Board members noted operational details (three to seven employees) and asked that the decision clearly limit the conditions to hazardous materials rather than all materials stored on site.
A motion to approve petition 5239 as requested, with incorporation of the Board of Health memorandum, passed unanimously (5–0). Chairman Iiggo reminded the applicant of the 20‑day appeal period and recording requirements at the Registry of Deeds; Attorney Cox agreed to provide a draft decision for the board to finalize.
