Platteville council weighs expanding sidewalk café permits amid enforcement concerns

Platteville — The Common Council discussed proposed amendments to the sidewalk café ordinance at its June 9 meeting that would broaden eligibility beyond licensed restaurants.

Joe introduced changes to Chapter 4.07 after a recent permit request from the 1906 Tavern revealed language tied to an obsolete Wisconsin statute and restricted eligibility to licensed restaurants. "The plan commission was recommending approval to open it up to other businesses beyond just licensed restaurants," Joe said, noting the goal is to allow cafes and similarly situated establishments to seek permits.

Council members asked about unintended consequences. A representative speaking for law enforcement warned about enforcement challenges: "From a law enforcement standpoint... it becomes a little bit difficult when you're crossing a sidewalk into an enclosed portion," the officer said, explaining that ensuring patrons remain seated and preventing open-container violations along the sidewalk can be challenging for downtown officers. Staff noted the proposed ordinance includes a provision that alcoholic beverages must be served by licensee employees to patrons seated at tables in the sidewalk café, and that time restrictions and service rules would be part of the permit.

Councilors said they were comfortable trying the change and monitoring its impacts, with some members noting the ordinance could be amended if problems arise. The planning commission recommended approval and the item will be on the action agenda at the next meeting for a formal vote.
