The Rutherford County Regional Planning Commission on June 8 denied a request to rezone roughly 4 acres at Shacklet Road for use by a concrete and contractor business.
Staff described the proposal as a partial rezoning of an 11.11-acre parcel to Commercial General for storage of materials and vehicles associated with a concrete business. Submitted materials listed proposed hours of operation, a gravel driveway and storage areas, and included a commitment that no materials would be sold on site; staff noted the area is predominantly single-family residential and questioned whether the request met the recommendations of Plan Rutherford.
Applicant Josel Dava described the operation as primarily a parking and staging area for trucks and trailers used on off-site jobs, saying employees would leave by about 6 a.m. and most heavy equipment would remain on job sites. He said thefts at jobs had caused losses of equipment and materials and that the site was needed for secure parking.
Multiple residents and County Commissioner Rick Col opposed the rezoning during the public hearing. Neighbors cited traffic concerns on the narrow Shacklet Road, potential property-value declines, proximity to river and flood-prone ground, wildlife impacts, and prior unpermitted activity. Tommy Hughes said the change would “devastate” his property and presented a petition against the rezoning.
Commissioners discussed the location’s lack of commercial corridors and staff concluded the request was not consistent with Plan Rutherford’s recommendations for the area. A motion to disapprove the rezoning passed on a roll-call vote; the application was denied.
Because the request was denied, no site-plan review or BZA action will follow for this proposal.
