Neighbor review sought for ADU covenant at 35 Middle Lane; hearing left open

The board kept a hearing open for 35 Middle Lane after the applicant’s attorney said he had revised a proposed ADU covenant to address a neighbor’s concerns.

John Tarbet told the board that a neighbor, identified in the file as Tom Korski, had submitted a letter raising fears the ADU could be rented to third parties, subdivided in the future, or otherwise be altered. Tarbet said the village requires a covenant for ADU approvals and that he added language to the covenant to address those concerns; he asked the board to hold the record open for two weeks in case the neighbor’s local counsel wished to review the draft. The board agreed to leave the hearing open until the next meeting to allow any comments to be filed.
