RSU 40 policy committee forwards revised public-participation policy to board after debate on enforcement language

The RSU 40 Policy Committee voted unanimously to forward a revised public-participation policy (Policy BH) to the full school board for first reading, after a lengthy discussion about how to define and enforce indecent or obscene language at meetings.

Committee members flagged a sample sentence that referred to remarks “uttered before 10 p.m.” as a poorly phrased example and agreed to strike or reword the time-based language so the policy aligns with legal definitions and recent guidance. Legal text blocks used in the draft were described during the meeting as the committee’s primary guidance for distinguishing indecency and obscenity.

Members debated whether the policy should say speakers are "required" to refrain from indecent or obscene language or whether the language should merely "encourage" such restraint. Several committee members argued that keeping a stronger, required formulation gives the chair and the board a clearer enforcement tool to address belligerent or obscene conduct and to protect students and meeting decorum. One member briefly offered an amendment to weaken that wording but withdrew it after discussion.

The committee also agreed to reorganize and clarify sections to separate general sign‑up and recognition procedures from rules of conduct, and to move a provision about requests for further information into a different subsection so the policy reads more coherently.

A motion to forward the revised Policy BH, incorporating the edits discussed, passed by voice vote 7–0. The committee recorded no public comments on the item during the meeting. The policy will next go to the full RSU 40 board for first reading and any additional revisions there.
