Staff presented application CC-2026-0000321 (Fort Smith subdivision), describing a first split from a 98.327-acre parent tract to create a roughly 2.5-acre lot for a single-family dwelling. Staff said the drainage board unanimously approved the request on May 5, 2026; the health department approved the lot’s suitability for a septic system; and County Highway raised no objection to driveway access.
Staff noted restrictive covenants must be properly prepared and incorporated with the plat and recommended granting primary approval subject to those covenants meeting the county legal reviewer’s satisfaction. Seth Johnson, representing 40th Parallel, told the board covenant revisions would be made on the secondary prior to signatures.
A board member moved to approve the primary plat; the motion was seconded and the commission recorded a unanimous roll-call vote granting primary approval. Staff instructed the petitioner to prepare and file a secondary plat once required signatures and covenant adjustments are completed.
Primary approval does not complete subdivision recording; the secondary plat and any required legal documentation remain necessary for finalization.
