Judge Frank Caprio reviewed a disputed payment record in Municipal Court of Providence and ordered the defendant to pay a remaining $30 within three weeks before dismissing the case.
The dispute centered on a $10-per-week payment plan for 15 weeks that the court had imposed as a condition for ticket dismissal (totaling $150). A court clerk told the judge the office’s records showed only $120 posted, while the meeting participant said they had paid $150.
“I did pay all of the 150, Your Honor,” the meeting participant said in court, listing several payments including $10, $20 and a $50 installment. A court clerk pushed back: “Every penny that’s come into this office has been to the right account,” saying the clerk’s office had double- and triple-checked its records and found $120 total.
The judge noted he had given the defendant a substantial break previously and pressed for responsibility under the payment arrangement. The judge told the defendant the consequence of failing to meet the terms would be reverting to the original fines but afforded additional time to resolve the remaining balance.
“I’m going to order you to pay the extra $30,” Judge Frank Caprio said, asking when the payment could be made and granting three weeks to pay. After the court was satisfied the required payments had been made, the judge announced the case would be dismissed and congratulated the defendant.
