Commission adopts stronger nuisance fees to tackle dust from large projects

The Beaver County Commission voted unanimously June 2 to adopt updates to the county nuisance fee schedule and related ordinance language to strengthen enforcement against large construction and solar projects that create dust problems.

Planning staff described the current penalty as effectively $2.99 per day, which they said is insufficient to deter noncompliance. "The teeth right now is $2.99 per day is nothing for these companies to even — they would stop watering and say, ‘OK, we'll pay $299,’" planning staff said, arguing that a broader fine range would give regulators leverage to compel mitigation.

The new schedule sets a maximum fine up to $15,000 (benchmarked from other jurisdictions) but commissioners clarified that enforcement will be calibrated by project size and will not automatically start at the maximum. Commissioners discussed operational fixes the county can require before assessing larger fines, including limiting initial grading to a small percentage of a project (for example a 10% cap before stabilization is required), mandating permanent vegetation or stabilization in disturbed areas and requiring contractors to water or gravel high-traffic/disturbed work zones.

The commission instructed staff to adopt a stepped enforcement approach: warnings and corrective actions first, escalating to fines sized to the severity and duration of the violation. The motion to adopt the fee changes passed by unanimous voice vote.
