Streets & Sewers committee sends Patton Street alley vacation ordinance to council

The Streets & Sewers committee recommended that the Marion City Council approve an ordinance to vacate part of a 16.5-foot public alley lying east of lots 670–671 and west of lots 684–685 in the Patent and Wallace addition to the city.

The clerk read the ordinance and noted the planning commission’s recommendation to approve. Committee members discussed two amendments: requiring a fire gate to ensure emergency access and inserting language that would prohibit structures within the permanent easement retained by the city. The committee confirmed with Mr. Daniels and other staff that as long as the fire gate provides ready access off Patton Street, the fire department had no objection.

A committee member moved to send the ordinance to council with a recommendation to approve, the motion was seconded, and the committee recorded affirmative roll-call votes to forward the measure.

The committee asked staff to incorporate the two amendments into the document before it goes to council and agreed the ordinance could be transmitted to council prior to the next full meeting if the amendments are included.

No final council action occurred at this meeting; the committee’s recommendation will be accompanied by the staff-inserted amendments when the ordinance is filed with council.
