Board upholds planning director on farm‑dwelling appeal; findings due in three weeks

The Yamhill County Board of Commissioners deliberated May 28 on a continued appeal (Docket FD‑01‑26) of the planning director’s approval to allow a principal dwelling associated with farm use. Planning staff reviewed the applicable 1994 state standard and recommended upholding the director’s decision, saying the applicants provided substantial evidence that the property is in farm use and meets the statutory sales threshold.

A planning staff presenter summarized the standard: for properties without high‑value soils an applicant must show the property has been farmed and produced at least $40,000 in gross farm sales during the past two years or three of the last five. Staff said the applicants met those criteria and noted that the dwelling, if approved, can be granted only to the person or persons producing the farm income and that no additional dwellings may be on the subject tract.

During deliberation commissioners focused on the record and whether supplemental concerns raised by the appellant were relevant to the governing criteria. Finding that the review criteria were satisfied, the board moved to uphold the planning director’s approval by unanimous voice vote. The board instructed staff that formal findings will be prepared and returned in three weeks.
