The Board of Examiners for Nursing on May 20 declined a proposed consent order for Christina M. Martinez, APRN (petition 2024-317), after Department of Public Health attorneys presented allegations that Martinez injected dermal fillers without fully documented informed consent and failed to document device expiration and certain medication dispensing.
Attorney Joel Newton, speaking for the department, told the board the proposed order would place a reprimand on Martinez’s APRN license and require coursework in prescribing practice and documentation. Board members questioned why the draft contained no civil penalty. Mary Deepman said she did not understand why a fine was not included; Elizabeth Rivera Rodriguez said, "I would have suggested a fine to be attached to this." Members discussed penalty levels: Elizabeth proposed a minimum of $1,000 while other members suggested $10,000. Deputy Legal Director Liz Bannon advised that the statutory framework had changed recently and referenced section 19 A17 and a $25,000 figure discussed during the meeting.
After discussion the board voted to decline the proposed consent order and asked Department of Public Health attorneys to return with a revised document that addresses the board's concerns, including potential civil penalties and any additional remediation.
