The updated approach limits by-right residential fencing to qualifying major roads and arterial-street properties, clarifies administrative standards for setbacks, gate placement, visibility triangles and safety, and preserves by-right fences adjacent to non-residential districts (examples cited include fences behind Walgreens and along Joliet Road).
Board members identified a typographical error in the packet that mischaracterized some commercial-adjacent fences as special uses; staff said they would correct that to reflect that such fences remain by-right. Trustees also raised a question about a minimum setback provision (section 1B5) — whether mower-clearance considerations require a 3-foot setback rather than 2 feet — and staff committed to confirm and correct the draft if necessary.
Why it matters: The proposed rules aim to balance safety, privacy and neighborhood character while improving clarity and consistent enforcement. The village will publish a final draft online at least two weeks before the June 17 joint hearing and follow established public-notice procedures.
