HIALEAH — The Hialeah Planning and Zoning Board approved variances on May 13 to legalize an enclosed terrace and an existing 7‑foot wooden fence at 371 Pashihawa Drive, concluding the measures were compatible with the triangular lot configuration and neighborhood character, subject to conditions.

Staff said the property is in Deer Park, was originally platted in 1922 and contains about 6,412 square feet. A March 2026 code‑violation case cited an existing 7‑foot fence and an enclosed terrace built without permits (BWOP‑002311‑2026). Staff advised the owner that the hedges adjacent to the fence exceed the six‑foot maximum and must be trimmed to comply with code; staff recommended approval of the variances so the owner could obtain the required building permits and inspections to resolve the open violation.

The board moved and seconded approval with conditions. The conditions require the owner to trim and maintain hedges at or below six feet, apply for and obtain building permits and inspections necessary to legalize the terrace enclosure, and resolve the cited code violation. The approval does not grant new development rights beyond legalization and compliance with the city code.
