The Portage County Board of Commissioners voted to table Resolution No. 7 after a contentious discussion about whether to reallocate excess money from the clerk-of-court certificate-of-title special revenue fund.
The discussion centered on staff analysis showing more than $7 million in the certificate-of-title fund and a proposal to treat roughly $5.5 million as excess and return it to the general fund, with $569,000 identified to remain appropriated to the clerk’s budget. One commissioner warned that proceeding without adequate outreach to the clerk risked court action; another commissioner argued the board is following statutory guidance.
The exchange grew heated when a commissioner objected to moving the item forward without reaching the clerk of courts. That commissioner said, “we're gonna end up in in court on this,” and urged the board to at least contact the clerk before taking action. In response, the commissioner supporting the reallocation described the mechanics of the proposal and said staff had prepared a DocuSign-ready agreement for the clerk to review, stating, “I think this is to get the DocuSign that we are agreeing to sign the DocuSign. We're agreeing to sign the agreement.”
After debate about prior transfers, the fund’s restricted-use history, and whether some of the balances had already been redirected by resolution in prior years, the board voted to table Resolution No. 7 and directed staff to reach out to the clerk of courts for review and possible discussion at the next meeting.
Why it matters: the certificate-of-title fund is a special revenue account whose balances are intended for specific, court-related purposes; commissioners said returning excess money would address perceived long-term accumulation of unrestricted balances, while opponents warned of legal and procedural risk if the clerk is not involved.
