Magistrate finds continuing code violations at 4400 Colaridge Ave.; fines and lien authorized

Magistrate Don Wyn found on May 10, 2026, that the property at 4400 Colaridge Avenue remains in continuing violation of Titusville city code sections 12-23 and 13-26 and confirmed prior orders and penalties.

Staff told the magistrate the case (26-15) was previously heard on April 13, 2026, and that representatives for the respondent did not attend. Photos in the file and staff testimony showed no meaningful change in the property's condition since the prior hearing.

Wyn found notice requirements were met and that the property remained out of compliance. He imposed a continuing fine of $50 per day per violation beginning in May 2026 and confirmed administrative costs of $189.11 as part of the order. Wyn said a certified copy of the order may be recorded in the public records and would constitute a lien on the subject property if the costs and fines remain unpaid.

The magistrate directed that the respondent must notify code enforcement once the property is brought into compliance so staff can verify and close the enforcement matter. No one representing the property appeared at the hearing, according to the record.
