Storm Water Board grants waiver to allow alternate water-quality device for Chipotle redevelopment

The Greenwood Storm Water Board voted April 8 to grant a developer’s request to use an alternate water-quality best management practice (BMP) device on a Chipotle redevelopment instead of a device pre-approved by the New Jersey Department of Environmental Protection.

A representative for property owner Tommy English told the board the project site is fully impervious and was developed under earlier regulatory criteria; staff and outside reviewers recommended permitting a different BMP because it would provide an overall improvement in stormwater quality for the redevelopment. The board’s motion cites Greenwood Municipal Code Section 9-158A and related technical standards and conditions for a waiver.

Board members and staff said the alternate device had undergone third-party performance review at Tennessee Technological University that addresses treatment effectiveness. Staff also noted that the project’s treatment train will include an improved existing detention basin as a secondary BMP and that the applicant must provide a reported operation-and-maintenance manual to ensure continued inspection and long-term functionality.

The board moved and approved the waiver with conditions; the motion carried on an affirmative vote. The minutes record the board’s finding that the applicant met the criteria for a waiver under Greenwood Municipal Code section 9-162C as presented.
