Plan commission favorably certifies rezoning for four Mulberry lots

The Clinton County Area Plan Commission voted 6-0 to favorably certify a rezoning request from Fred 47 LLC that would change four platted Mulberry lots from I‑1 (light industrial) to R‑3 (medium‑density residential).

Staff explained that the county comprehensive plan and the town of Mulberry’s future land‑use map show the area as medium‑density residential and that the parcels sit amid residential zoning on three sides. Liz Ditzel said the rezoning would allow single‑family dwellings by right; any duplexes would still require a Board of Zoning Appeals special exception. She noted that the previous owner had proposed a storage‑unit facility but did not carry it forward, and that residential use would likely be more compatible with the surrounding neighborhood.

The applicant, J.B. Farrell, told the commission Mulberry has already approved a variance necessary for lot‑size relief and that he plans to pursue any required Board of Zoning Appeals filings if needed. Staff summarized a letter from Paul Harshman expressing concern about rentals and duplexes; Harshman said he supports single‑family homes or a storage facility but opposes downzoning if it will lead to apartments or rental properties. Ditzel said the letter did not change staff’s recommendation and reiterated that duplexes are not permitted by right in R‑3.

The commission will transmit its favorable certification to the Mulberry Town Board, which will hold its own hearing and make the final decision. Staff indicated Mulberry’s next meeting is May 6.
