Committee reviews technical edits to school-construction statute and arbitration rules for employee health benefits

The committee reviewed two technical but potentially significant statutory edits.

On school construction, counsel described an amendment to section 3448F (chapter 123) that adds the word 'addition' to the definition of cost-saving measures for performance contracting. Supporters said the insertion aims to remove ambiguity that has complicated performance contracting for building additions; counsel cautioned that the change could have substantive effects depending on what constitutes an 'addition' and recommended inviting John, who has examples, for a detailed walk-through.

Separately, the draft proposes a change to section 21105, the commission on public-school-employee health benefits dispute-resolution statute. Current law directs an arbitrator or the Vermont Labor Relations Board to select one party’s last-best offer in its entirety. The proposed amendment would permit selection of last-best offers on an issue-by-issue basis rather than forcing an all-or-nothing choice. Committee members said the provision produced robust debate and its final inclusion in the traveling bill remained uncertain.

Both items were noted for follow-up testimony; no formal committee action was recorded at the meeting.
