Board approves Lake George Courage Point final plat with $50,000 performance bond

The Hubbard County Board on Tuesday approved the final plat for Lake George Courage Point, contingent on a performance bond to ensure removal of nonconforming structures near the ordinary high-water mark.

Planning staff told the board that all conditions attached to the preliminary plat have been addressed: a flagged lot was placed into Torrens title as required, two septic tanks that failed setbacks were abandoned with documentation on file, and the applicants posted a performance bond to secure removal of nonconforming structures within six months of final-plat approval.

Staff said the bond is $50,000 — roughly 1.5 times the contractor’s removal estimate of $30,900 — and named Hubbard County as the obligee on the bond. The bond language specifies removal of all nonconforming structures within the 100-foot ordinary high-water mark except for one structure previously authorized by variance. Planning staff said the bond wording can be tightened if commissioners wish.

KJ Land Company representative Mr. Donabower was present during the presentation and available to answer questions. After discussion and a motion to approve the planning commission recommendation, the board adopted the final plat with the performance bond as a condition; the six-month compliance clock begins on the date of approval.

What’s next: staff will file final-plat documents and the county will monitor compliance with the removal condition; if applicants fail to remove structures within six months, the county may act on the bond to hire a contractor for removal.
