Commission issues negative determination with conditions for carport at 31 Traverse Street

The commission considered a request for termination of applicability (negative determination no. 3) for a proposed carport at 31 Traverse Street. The applicant said relocating the carport to the left side of the garage would place it nearly 50 feet from the brook and limit disturbance to three post holes and minor paving (regrind asphalt or graded base).

Commission members reviewed floodplain and regulatory maps and discussed whether the work would alter resource areas or riverfront setbacks. Staff confirmed the scope of work is within the buffer zone but concluded it would not alter an area subject to jurisdiction under the Act, provided conditions are met. The commission approved a negative determination no. 3 with conditions: use graded base (rather than fresh asphalt), place erosion controls in advance of any excavation and remove them after site visit verification, and notify the conservation agent at project start and upon completion.

The agent said the permit will include a 10-day appeal period after issuance. The commission closed the hearing and directed staff to prepare the permit and coordinate inspections at start and completion.
