The Town of Falmouth Board of Health approved a draft operator-of-record letter on April 13 directing operators of onsite treatment systems (IAS) to review monitoring results after staff flagged one or more systems that may not meet their approved total-nitrogen discharge limits.
Staff said the attached graphs show sample results against a 19 mg/L benchmark used for many legacy approvals, and noted that some newer approvals use a 10 mg/L standard; therefore the graphs will be tailored to show the appropriate red line for each system. The draft letter and graphics will be finalized after staff "crunch" the data and append a property list for operators.
"Recent data indicate that one or more of these systems are not meeting their approved nitrogen discharge limits," a staff presenter said, noting that the red dotted line on the graphs corresponds to 19 mg/L for systems approved to that standard.
Why it matters: operators who are listed on record may need to increase sampling or take corrective actions if monitoring confirms exceedances. Staff emphasized that the attached list only includes properties for which monitoring data have been submitted to the town database; some operator-listed systems may lack samples in the town's files and will require separate follow-up.
Key board directions
- Approve the operator-of-record letter with minor editorial changes made during the meeting and have Scott (health-department staff) send it once numbers are finalized. Staff expected to finish the analysis within a couple of weeks to allow roughly 15 working days' notice ahead of a follow-up outreach meeting.
- Clarify graphs by showing the correct red-dotted limit (10 mg/L or 19 mg/L) for each system and attach a property list identifying systems for which monitoring data are available.
- Recognize that sample counts vary across systems (some have many samples; others have only a few) and that absence of samples in the town database does not mean an operator has no responsibility for other systems not shown.
Attribution and process notes
The board's action authorized staff to finalize the letter and transmit it to operators. Members emphasized the need for careful presentation of sample sizes and standards to avoid mischaracterizing compliance.
Next step
Staff will provide the completed graphs and the attached property list to Scott for transmission to operators and will schedule a follow-up meeting (May 11 referenced) for further discussion.
