Zoning board approves ADU at 52 Albany Avenue with conditions

The Town of Babylon Zoning Board of Appeals approved an application for an accessory dwelling unit at 52 Albany Avenue during its meeting, imposing three conditions the board said would protect neighborhood form and ensure code compliance.

Alex Askew, the applicant, said the ADU was part of the Community Development and Land Implementation (CDLI) program and that the project team chose a vertical addition rather than expanding the yard because of site limitations. He told the board the ADU had been approved by CDLI during the program review.

Board counsel and staff said the board would attach conditions to the variance: a single front door to the building, internal access throughout the structure so the ADU is not separately accessed from outside, and a requirement that the accessory-apartment permit be maintained for as long as the unit exists. The applicant confirmed agreement with those conditions at the hearing.

A board member moved to approve application 26-37 with the three planning-memo conditions; the motion was seconded and carried on a voice vote. The board did not record a roll-call tally in the public record at the hearing.

Next steps: staff will issue a written decision and the board’s conditions will be listed in the approval; the applicant must secure the accessory-apartment permit and any building permits required for construction or modification.
