The City Commission of the City of West Miami on May 13 tabled consideration of a proposed mitigation offer connected to code-enforcement liens at 6437 Southwest 16th Street.
City Manager (staff) explained the item was brought back after being deferred at the prior meeting and described a proposed stipulation: the prospective buyer, identified in the record as Mr. Aguilar, has offered to negotiate mitigation but did not disclose the purchase price. The manager said the existing documentation shows a construction scope exceeding $380,000 and that the seller of record purchased the property at foreclosure.
Commissioners raised questions about who the commission should be negotiating with. One commissioner objected to any dollar amount appearing in the minutes when it had not been discussed with the current property owner and said, "I would want him to not only come and speak under oath to the commission, but we would also need to mitigate something that is fair to the city" (Committee member). Another commissioner noted the investor bought the lot at a low price and cautioned the city not to forfeit money owed: "They got a hell of a deal" (Commissioner Juan Blanes).
City Attorney and staff clarified that approving a mitigation resolution would alter the lien for the current property owner and that, as written, the mitigation could be interpreted as effectuating that change even if the buyer had not formally accepted the stated amount.
After discussion about negotiating with the current owner versus a prospective purchaser, and requests that the city manager obtain fuller disclosure and have the current owner appear, the commission moved and voted to table the item to a future meeting so staff could gather additional facts. The motion carried unanimously.
Next steps: staff will report back with documentation on ownership, the purchase price, and a proposed mitigation agreement for further consideration.
