City and county attorney Nancy Rogers told the Broomfield City Council on May 12 that the developer of the Broomfield Town Square has requested postponement of a scheduled vote on a site-development plan extension so the city and the developer can negotiate a potential amendment to the 2019 redevelopment and reimbursement agreement.
Rogers said the developer’s request would link consideration of a site-plan extension to a possible change that would extend the tax-increment financing (the return of sales, property and use taxes to the developer) beyond its current 2044 end date, potentially to 2050. "Staff is going to move forward with negotiations with the developer," Rogers said, adding that no commitment or final wording has been made and any amendment would come back to a public meeting for council consideration and public comment.
Public commenter Marlene Erickson urged the council not to grant further extensions and instead to declare a breach of the development agreement, citing local news reporting that the project’s cost has grown and that taxpayers could be liable for tens of millions in public investment. Erickson characterized the developer’s timeline and past performance as insufficient and urged council to hold firm rather than grant additional time.
City staff told the council they would begin negotiations the following day, schedule follow-up sessions including possible executive sessions, and aim to return the item to council in mid‑June depending on how talks proceed.
Next steps: staff will negotiate with the developer, schedule executive sessions if needed, and bring any proposed amendment or extension back to council for public consideration and a vote.
