Council rejects effort to send abortion‑clinic exemption back to planning commission

A council motion to direct the planning commission to consider removing the 'family planning services' exclusion from the city’s abortion‑clinic definition failed 2–5 on May 12.

Public commenters and multiple council members framed the item as both a legal and moral question. Greg Berry (S17), representing the Lynchburg Guardians, urged council to keep the ordinance language intact: “The language excluding family planning services was intentionally designed… Removing that language now risks weakening an ordinance that many citizens supported,” he said.

Council and staff discussed legal defensibility and practical limits of local zoning. The city attorney (S12) told council that because the ordinance currently excludes undefined “family planning services,” removing that exclusion without a clear definition could create ambiguity that an attorney might exploit. Several council members said the ordinance had been crafted carefully and warned reopening it could expose the city to litigation or create unintended consequences for other outpatient providers.

Council rejected the motion to send the exemption back to the planning commission. A subsequent procedural motion to pause reintroduction for six months also failed. The council did, however, vote later in the meeting to release a limited portion of attorney correspondence on the topic (see separate article).
