The Nashua Zoning Board of Adjustment on May 12 granted a special exception to homeowners Mark Lessard and Jane McCutchen to construct a 12-by-12 deck at 26 Verona Street within the 75-foot Salmon Brook prime wetland buffer.
Chair Jay Menkara read the application into the record and described the difference between special exceptions and variances under the city’s land-use code. Applicant Mark Lessard told the board the deck will have no stairs or roof and that the pair had received a “positive recommendation from the Conservation Commission.” “We’re putting a 12 by 12 deck on the back of the house so that we can enjoy the property,” Lessard said.
The board noted the Conservation Commission’s recommendation dated May 6 and asked no additional questions. There were no speakers in favor or opposition at the public hearing.
JP Boucher moved to approve the special exception with the three stipulations included in the Conservation Commission letter; the motion was seconded and the board approved the application. Menkara reminded the applicants there is a 30-day appeal window before the decision is final.
The approval allows the homeowners to begin their project subject to any conservation-stipulated conditions and applicable permitting timelines.
