The Mobile City Council discussed a proposed vacation of unused right-of-way adjacent to property at 6401 Overlook Road and the related vacation fee, which the city clerk calculated at $36,848.95.
One council member opposed waiving the fee, saying the city’s ordinance was established to prevent recurring fee-waiver requests and that making an exception for this church would invite similar requests from other churches and businesses. "If it was 5,000 or less, it's automatically waived, but this is nearly $37,000," the member said, urging adherence to the existing ordinance rather than a large waiver.
The council member acknowledged sympathy for the church’s building costs but said the council had previously worked to set a standard for waivers and should not make an exception without a compelling reason. The clerk and other members noted that the vacation and fee were on the agenda; the council did not finalize a waiver decision at the pre-meeting and indicated the item would be discussed on the formal agenda.
Council members asked for more information about the property and the grounds for a fee waiver, and the council recorded the fee amount for later consideration during the public hearing process.
