Appellant counsel argued the city had not proven the constitutional standards for a demolition taking and urged the council to delay enforcement until a redevelopment application was approved. City staff, including Planning Director Jonathan Le and the chief building official, presented declarations and inspection findings describing widespread problems: corroded and nonfunctional fire‑suppression and alarm systems, severe electrical and plumbing deterioration, structural deterioration (including exposed/corroded rebar), unpermitted alterations that compromise fire separations and egress, and hazardous‑materials storage removed only after remediation efforts.

Fire Marshal Tamara Jasso testified that the building’s condition prevented safe interior firefighting and that nonfunctional alarms and compromised fire doors and firewalls made the structure a hazard to first responders and neighboring properties. "Buildings with non‑functional fire protection systems are by definition fire hazards under applicable codes," she testified.

Council members heard public comment from neighbors who described trespass, discarded needles and other activity near the vacant property and urged immediate demolition. City staff proposed findings under municipal code that would permit demolition if one or more statutory conditions are met; staff argued the record demonstrates those conditions. Appellant counsel reiterated that the owners had been attempting parallel permit pathways and asked the council to tie demolition relief to approval of a redevelopment plan; staff replied that outstanding permit submittals were incomplete and that the building’s hazards required action.
