Owner Abraham Garcia acknowledged he began construction after purchasing the property and that work proceeded without prior permits. Staff told the board the requested variation of use and the setback variation would be needed because the second‑story addition increased an existing nonconformity. The owner said he has engaged architects and would submit required plans for permits and inspections, but several board members expressed concern the work had progressed without inspections.
Architect Bob Gable of United Architects explained the structural approach taken in the current work (double floor joists, 2x4 exterior walls) and said plans would be submitted that meet code, but board members said the hardships appeared self‑imposed and that the lack of prior permitting and inspection raised safety and oversight concerns. Several members recounted past cases where unpermitted additions led the board to require removal.
After deliberation, the board voted to recommend denial and to forward that recommendation to City Council along with the tied setback variation. Staff noted that if the owner later pursues permits and the work is found to meet code, the owner could reapply; for now, the board recommended denial based on the record presented.
