The Area Plan Commission unanimously approved a request to rezone two parcels at 1205 Fort Harrison Road and 3317 North 12th Street from R1, single-family residential, to C1, neighborhood commerce district, allowing business and professional offices.
Staff presented the application (file 12 2026, Document 28) and recommended a favorable recommendation conditioned on submission and approval of a site plan by the Department of Engineering and the issuance of approved 911 addresses. The staff report noted the site is in a mixed-use area with commercial, residential and manufacturing neighbors and said the proposed use should not alter the character of the adjacent parcels or create significant problems for surrounding properties.
Richard Shagley, attorney with Wright, Shagley & Lowry, spoke on behalf of the property owner and asked the commission to grant the rezoning. "My name is Richard Shagley. I'm with the law firm Wright, Shagley, and Lowry. And tonight it's my honor to be here on behalf of the property owner, Rick Laser," Shagley said, adding that the potential owner understands C1 requirements and expects to satisfy site-plan conditions.
Commissioners asked no substantive questions, and the commission moved, seconded and approved the rezoning by voice vote.
The commission’s approval is conditioned on the applicant filing a site plan acceptable to the Department of Engineering and obtaining approved 911 addresses before occupancy. The applicant will need to follow the city’s site-plan review process and any engineering conditions noted by staff.
The rezoning will next proceed through the required administrative steps for site-plan review and any subsequent permitting.
