The Hamilton County Drainage Board on May 11 approved a petition from Executive Investments LLC to reconstruct a portion of the Margaret O’Brien Drain, including enclosure of 76 feet of open ditch and installation of 68 feet of 48‑inch reinforced concrete pipe and a 16-by-8-foot reinforced concrete structure to extend an existing tile segment and allow a driveway to the adjoining parcel.
A staff member described the petition as a developer-funded reconstruction, stated the affected parcels are both owned by the petitioner, and said the work meets the requirements of Indiana Code 36-9-27-52.5 for a 52.5 hearing. The board opened the required public hearing, heard no comments, and approved the reconstruction after a motion and second; the vote was taken by voice and the chair announced the motion carried.
The staff presentation said no new easement acquisition is required because the reconstruction will occur entirely on parcels owned by the petitioner and that the applicant will post any required surety after approval. The enclosure is intended to extend a tile segment that was installed for the Crosspointe Business Park arm in 1986 and to provide driveway access to the parcel to the south.
Board members did not request additional conditions during the meeting. The staff recommendation and the board’s approval advance the reconstruction to the next permitting and construction steps; the petitioner is responsible for paying reconstruction costs and for arranging any surety or bonding required by county process.
Next steps: staff will coordinate permit and surety processing with the petitioner and circulate project timelines and requirements as applicable.
