The Fall River Conservation Commission voted 4-0 on April 6 to deny a notice of intent filed for 565 Detroit Street, concluding the proposal to install an inground pool, upgrade the pad and add a paver patio cannot meet the commission’s performance standards.
Commission staff told members the application, filed on behalf of applicant Marco Fritz, had been tabled multiple times over nearly a year and that reviewers found previously completed work encroaching on a previously approved wetland. "We cannot permit the proposed activities and meet the performance standards," staff said, recommending denial after the applicant failed to submit revised plans addressing the commission's comments.
A member moved to deny the filing; the motion was seconded and carried on a roll-call vote. Staff confirmed the commission will issue a formal denial notice to the applicant and said the applicant may pursue the appeal options available under state procedures. Staff said it will allow the appeal period to expire before deciding whether to initiate an enforcement action related to the unpermitted work.
The decision leaves open an administrative appeal by the applicant, and the commission noted that enforcement action remains possible after the appeal window closes. The commission also reiterated its expectation that applicants respond to requested plan revisions in a timely manner to avoid repeat postponements.
The commission’s action followed a staff presentation and deliberation and was recorded by roll call; the vote tally was 4 in favor, 0 opposed.
