Commission grants extension for Bourne Mill Marina expansion; Army Corps and Chapter 91 filings placed on file

The Fall River Conservation Commission voted April 6 to grant a two-year extension to the order of conditions for the Bourne Mill Marina expansion (52 Ferry LLC, SE-24-827). Attorney Mark Levin, representing the applicant, told the commission that delays in state approvals and supply-chain issues mean the project cannot meet the prior expiration timeline.

"It's going to take about a year just to get all the materials he needs to bring to the site to start operating," Levin said, asking the commission to grant the maximum extension to create a recordable document for title and financing purposes. Commissioners voted to extend the permit term accordingly.

The meeting also recorded that the applicant has progressed through the Chapter 91 state process and is before the U.S. Army Corps of Engineers for federal construction permitting; the Corps submission was placed on file and members acknowledged the multi-agency review steps required before on-water construction can proceed.

Staff explained the typical permitting sequence: commission approval with conditions, Chapter 91 licensing at the state level, and Army Corps construction permits at the federal level. Commission action to extend the local order of conditions will allow the applicant to continue seeking state and federal approvals without the local permit expiring in the interim.

The extension motion passed on a roll-call vote; staff will update the project record and retain related filings on file for the Corps and DEP processes.
