City attorney says Hialeah-style senior tax rebate likely violates Florida Constitution; staff to research options

Commissioner Joseph asked staff to evaluate a property tax rebate program for low‑income seniors modeled on a Hialeah ordinance that provides checks to certain senior homeowners.

City legal staff explained the constitutional and statutory limits on ad valorem taxation and exemptions: local governments cannot unilaterally create new ad valorem exemptions or rebates that effectively alter taxing authority without state or voter approval. The city attorney said Hialeah’s approach appears to attempt a back‑end rebate that the attorney believes is a circumvention of the Constitution and that, even if implemented, would carry legal risk.

Staff said the city’s current code already contains the standard homestead exemptions for seniors and the additional longevity exemptions available under state rules. Any new rebate tied to ad valorem taxes could require constitutional amendment or statewide voter action. The city manager and attorney advised caution and recommended staff research the Hialeah implementation, Miami precedents and whether a legally permissible alternative (non‑ad‑valorem funding or targeted social programs) exists.
