Brevard County commissioners on April 7 approved a waiver of a sidewalk installation requirement for the Green Leaf subdivision in West Melbourne after a contested exchange between the developer and city staff over plan annotations and right-of-way constraints.
Applicant Jim Swan (project manager) said construction drawings and driveway-permit materials did not require the exterior sidewalk and that a narrow right-of-way plus an open drainage ditch presented substantial engineering constraints that would require piping the ditch and a more costly redesign to accommodate a sidewalk. City of West Melbourne staff said their approved subdivision plans included a sidewalk depiction and noted the city's policy to promote pedestrian and biking environments, particularly given a nearby school.
Commissioners debated whether the waiver met code criteria and whether the developer should be bound to construct the sidewalk or later be assessed when the county or adjoining properties decide to install a connecting segment. County staff noted that for board‑approved waivers the assessment agreement is discretionary and could be attached if the board so chooses. The board ultimately approved the waiver after motions and votes; several commissioners asked staff to consider an assessment agreement or future contribution mechanism should a connecting sidewalk later be installed.
The vote resolves an outstanding compliance question for the subdivision's final platting and leaves open the option for future assessment or county-led construction if community priorities change.
