Council approves MOU to formalize collaboration with building-industry association after debate

The Cape Coral City Council voted April 1 to approve Resolution 94-26, a memorandum of understanding that formalizes collaboration with a county building-industry association to share data, coordinate meetings and improve permitting comparisons across jurisdictions.

The City Manager described the MOU as an effort to “formalize an agreement with them to begin a partnership… that will give us greater optics into what we’re doing” and to allow comparative analysis rather than contacting multiple agencies one-by-one. He said the association already exchanges information with other agencies and the MOU was intended to establish a more structured, recurring process.

Several council members supported the measure as an enhancement to existing relationships and a way to improve consistency for contractors who work across jurisdictions. Councilmember Kilroy said he supported expanding vendor relationships through formal collaboration.

Other members questioned whether a written MOU was necessary given longstanding informal cooperation. One councillor cited recent audit activity and said a formal agreement could create adverse optics; that member said, “I don’t like how that looks… for that reason I’m going to vote no,” and opposed the resolution on that basis. Supporters countered that formalizing meetings would provide clearer channels for feedback and help contractors understand city approaches.

Outcome and next steps: The council carried the resolution (vote recorded in the minutes) and asked staff to proceed with the collaborative meetings described in the MOU. Council asked for clarity on how confidential information would be handled and requested the administrative procedures be spelled out in return materials.
