Rutherford County library board hires outside counsel, limits initial spending to $3,000

The Rutherford County Library System Board voted to engage outside counsel on March 30, approving an engagement with attorney Larry Crane with a $3,000 retainer and a $400 hourly rate, and authorized drawing the retainer from the system's fund balance.

Board members debated the decision after public comment and questions about process and cost. Lynn Reynolds, a library board member, said members had received the engagement letter late and asked, "Why only one lawyer are we getting to choose from tonight?" Reynolds pressed the board for a more transparent vetting process before committing to legal fees.

Other members raised financial concerns. Allison Belt asked how the board would pay for the work, noting the retainer and rate: "He is requiring $3,000 essentially retainer drawdown amount $400 an hour," and urged a cap on expenditures. Beth Dafford moved to amend the engagement to limit initial spending to the $3,000 retainer; the amendment was seconded and adopted.

After debate the board adopted a motion to engage Crane with the $3,000 cap and to fund that retainer from the library system's fund balance. The clerk conducted a roll-call vote with recorded votes in the meeting transcript; the motion carried.

The board then recessed into an executive session for attorney–board consultation, as outlined on the agenda. The board returned to open session after consulting counsel and proceeded to later agenda items.

What happens next: the board authorized the executive committee to manage follow-up legal engagement and to request additional funding if necessary, subject to future board approval.
