EMC Planning Group presented a cultural resources analysis recommending the Local Coastal Program replace the term “archaeological resources” with “cultural resources” and “tribal cultural resources,” and update LCP procedures to align with CEQA guidance and the Coastal Commission’s tribal consultation policy.
Holly Whittinger (EMC) outlined two procedure options for cultural‑resource screening: (1) refer projects to the Northwest Information Center (NWIC) and require archaeological surveys only when NWIC or other screening indicates medium‑to‑high probability of resources, or (2) require archaeological surveys for all discretionary projects. County staff said they prefer option 1 to avoid imposing unnecessary costs on applicants when NWIC records indicate a low probability of resources.
Public commenters—including tribal representatives and local planning consultants—urged caution relying solely on NWIC because its records can be incomplete. Valerie Stanley of the Sherwood Valley Tribe and other tribal commenters said many culturally significant places have never been formally recorded and stressed early, direct tribal consultation and discovery protocols. Amy Winn and other public commenters said the archaeological commission provided valuable local nuance and early guidance and urged the county to retain or replicate that local expertise.
Deputy County Counsel Matthew Kudrowski explained the board’s prior direction to consider dissolving the archaeological commission was driven by a tension between Brown Act open‑meeting requirements for a public body and the confidentiality often needed when handling sensitive cultural‑resource information. He said staff are seeking approaches that maintain protections without violating public‑meeting law.
Staff said discovery clauses and notification procedures will remain in place and that the county will continue to consult tribes and follow state law (including AB 52 and SB 18 references in the presentation) as LCP updates proceed. The commission did not vote; staff will return with recommended policy language and implementation procedures.
