The court on the docket for case 2023CR10135 heard arguments on a defense motion to set bond and the state's request that the defendant remain remanded without bond. The state told the judge it believes the defendant is a flight risk and a danger to the alleged victim because new assault allegations and an additional assault with a deadly weapon charge are pending.
"So not only is this defendant a flight risk, but he is a danger to this victim and potentially to the rest of the community, your honor," the prosecutor said, arguing the court should keep the defendant remanded without bond. The prosecutor also said one allegation in the motion to revoke was that the defendant had not reported for over a year.
Defense counsel asked the court to allow the defendant to post bond so he could address personal affairs and said the prior bond had been $10,000. The judge told the parties she would not issue an immediate ruling and reminded them that, even under the recent changes to bond law, the rules of evidence still apply when the court is asked to deny bond.
"Denying a bond, increasing a bond — the rules of evidence still apply," the judge said, directing both sides to bring stipulations and any witnesses they intend to use. The judge offered to recall the matter next week and set aside time for a contested hearing and told the parties she would allow 20 days for preparation if the hearing is contested.
The defendant, who answered "Yes, ma'am" when the court asked if he was Adam Gonzales, did not receive a ruling on the motion at the hearing; the court deferred the decision pending clarification of stipulations and the presentation of evidence at the newly scheduled contested hearing.
