The Adelanto City Council on Oct. 27 voted to recess into a closed session to discuss real-property lease negotiations for a parcel identified in the record as 12000 Stadium Way in Adelanto, California.
The city attorney said, “There is 1 item on the closed session agenda this evening,” identifying the matter as a “conference with real property negotiators pursuant to Government Code section 54956.8,” and said the city’s negotiators would include the city manager and the city attorney and that the subject of negotiation was “lease price and terms.”
Mayor Reyes opened the meeting and called for roll call, after which the council moved to approve the agenda. The mayor then opened public comment specifically on the closed-session item at about 6:03; Clerk Brenda stated that no callers were on the line, and public comment was closed at about 6:04.
Following that, the mayor moved that the council recess to closed session to discuss the announced real-property matter. The motion was seconded and the council’s recorded affirmations on the roll call in the transcript indicate the motion passed.
Under Government Code section 54956.8, closed sessions for real-property negotiations are permitted so long as the council publicly announces the legal authority and general subject matter being negotiated; the city attorney made that announcement in the open session. The council recessed to closed session at approximately 6:04. The transcript of the open session contains no report of any final action on the property; any formal action resulting from the closed session would be reported as required by law in a subsequent public record.
