A legislative committee approved three rule-related resolutions Tuesday, adopting a medical marijuana regulation, a rule implementing provisions of last year’s HB 1576 for the Oklahoma Health Care Authority, and a late-noticed rule for an enterprise-services vendor.
The chair moved to adopt HJR 10 96, which the presenter described as “a resolution approving [a] medical marijuana rule that was originally considered a major rule,” and said it had been pulled from earlier consideration but still required committee approval. The presiding officer then called for a vote and, after the clerk read member votes, declared the resolution passed (reported as eight yes and one nay). The chair spoke for the motion and moved adoption; the presiding officer pronounced the bill passed.
The committee next considered HCR 10 99. “HCR 10 99 is a direct result of HB 15 76, which was passed by the legislature last year, regarding rules with the Oklahoma Health Care Authority,” the chair said before moving for adoption. The presiding officer noted a full proposed committee substitute (PCS) on the file and, seeing no objection, accepted unanimous consent to receive and adopt the PCS; the clerk later confirmed the tally as eight in favor, zero nays.
Finally, the committee took up HCR 1,100, described in the hearing as “dealing with the rule to Yokoma management enterprise services that we discovered was major at a very late date” and moved for adoption. Members again voted in favor; the presiding officer announced the motion passed unanimously and returned the chairmanship to the original chair.
A member, Representative Chapman, asked whether there was commentary or notation members should know about the late change to HCR 1,100’s major-rule implication. The chair said the matter could be discussed later the same day. The chair also announced the committee will meet again at 9 a.m. to address a late resolution that surfaced after adjournment.
