Montgomery County adopts Vehicle Recovery Act to ease towing hurdles for families; lawmakers cite ICE detentions

The Montgomery County Council unanimously approved Expedited Bill 14-26 on April 28, 2026, amending county towing and vehicle redemption rules to ease burdens on families when an owner is not present.

The joint Government Operations and Public Safety committees recommended amendments that allow a vehicle to be released to an authorized agent upon submission of appropriate personal identification and documentation establishing a familial or household relationship. The committee widened acceptable proof to include current or temporary registration rather than limiting release to a Maryland registration and added a requirement that the owner provide authorization rather than presuming agency authorization. The bill also clarifies indemnification language and relocates towing-related code to a consolidated chapter.

Committee members cited examples from prior public hearings, including instances when vehicles were left after ICE detentions, and said the changes intend to reduce logistical burdens on families who must retrieve property while coping with a detention. The committees acknowledged the need for proper identification and safeguards to prevent improper releases.

The council approved the bill by roll call; the clerk announced the measure passed unanimously. Committee staff credited detailed code cleanup and cross-agency collaboration, including coordination with the city of Takoma Park Police Department.
