Kane County commissioners on April 28 corrected a previous omission and approved Ordinance 2026-12, changing the county land-use code so that actions authorized by conditional-use permits must commence within two years of permit issuance.
The amended language establishes a two-year commencement period for permit holders; if a permit holder does not commence activity within that time the permit will expire and the holder must reapply. The planning commission was given explicit authority to grant extensions in one-year increments for good cause.
Chair moved the corrected motion to restate the two-year commencement period (and to clarify that extensions are determined by the planning commission). Commissioners voted by voice; the motion carried. There was no public comment on the ordinance during the meeting.
The measure replaces the prior language that had unintentionally omitted the two-year commencement window when the motion was made at an earlier meeting. Staff indicated the change will be incorporated into Title 9, Chapter 15 of the Kane County Land Use Ordinance and published following the commission's action.
