Resident urges Erath County to clarify private road maintenance after gate removed

Amber Smith, introduced by the presiding officer as a public commenter, told the Erath County Commissioners Court on April 27 that a neighborhood gate was removed March 29 and residents now face uncertainty about whether the road is maintained by the county or by private owners.

“We need clear determination regarding emergency access,” Smith said, arguing that county officials had told residents emergency vehicles may be delayed because ownership and maintenance responsibilities were unclear. She asked the court to clarify three points: whether the road is owned by the county or by individuals, whether a maintenance plan was ever filed with the county, and whether a 1983 discontinuation document (which Smith said named a prior owner) remains valid now that the number of lots has increased from five to nine.

Smith said the gate removal followed conversations with Commissioner Edwards and neighborhood outreach that produced mixed feedback about whether the gate should remain. She described the issue as a public-safety concern and urged timely direction from the court so emergency responders would have recognized access to the homes.
