The Boulder Planning Commission voted unanimously on April 21 to transmit the draft Residential Short-Term Rental (RSTR) conditional-use-permit (CUP) application to the town council for adoption.
Planning staff Aaron previewed the draft application and related project-permit materials earlier in the meeting, noting the form asks applicants for site maps, proof of residency and uploads such as a county safety/inspection report. The form reflects a code provision that limits RSTR slots to 12; the chair noted the code leaves unanswered procedural details about a lottery if more than 12 applicants seek permits.
The commission asked several procedural questions. Commissioner Jen Bach asked whether a tenant can serve as the on-site manager; commissioners recalled that was proposed but did not make it into the final code. Phoenix Bunky urged adding or ensuring an applicant's description includes how a host will mitigate impacts to neighbors (for example, noise and parties), prompting staff to confirm the application requests a proposed RSTR description and uploads including a site plan and county inspection report.
When the chair asked for a motion to transmit the draft to the town council, the chair moved the item, Commissioner Elena Hughes seconded, and the body approved the transmission by unanimous voice vote. The chair said he would transmit the form to council; the council is scheduled to consider it at its May 5 meeting.
What the motion does: Transmission sends the draft application form and project permit materials to the town council for formal adoption. It does not change the underlying ordinance (that is the council's role) and does not create any immediate certificates or permits until the council acts.
Follow-up items recorded at the meeting included clarifying lottery procedures for the 12-slot cap, confirming whether renters can serve as on-site managers in code language (not currently in the adopted code), and whether the application should require explicit mitigation plans or house rules to be posted as part of the submission.
