Council remands PD‑46 outside‑storage request after citing enforcement gaps and missing materials

The Rockwall City Council on April 20 unanimously remanded a request to amend Planned Development District 46 that would add an outside‑storage allowance at 3301 Springer Road. Staff told council the property had multiple code enforcement citations and no completed application materials; the Planning & Zoning Commission had recommended denial 7–0.

At the public hearing, the applicant’s representative (identified as the chief operating officer of the applicant company) said they had not fully understood the permitting process, acknowledged recent citations and payments, and asked to withdraw the application to resubmit with complete materials. Staff cautioned that because the business had been operating in violation of code, citations could be required if there is no active application on file.

Councilmembers pressed the applicant on follow‑through and documentation. After discussion, the council voted to remand the case to Planning & Zoning so staff and the applicant could work through deficiencies and present a complete submission rather than denying or forcing re‑filing. Council emphasized the applicant must work closely with staff and secure necessary inspections and certificates before returning to the council.

The Planning & Zoning Commission’s 7–0 recommendation to deny the amendment means any future council approval would require a supermajority; remand preserves the applicant’s ability to address deficiencies before another council hearing.
